Mithat Tercan is the founding partner of Tercan Legal. He advises foreign companies, investors and financial institutions on Turkish law, with a practice centred on banking and finance, foreign investment, cross-border disputes and debt restructuring.
Background
Banking experience within Gulf banking groups
Before founding the firm, Mithat served as in-house counsel at Türkiye Finans Katılım Bankası, a member of the Saudi National Bank (SNB, formerly NCB) group, and as counsel to Kuveyt Türk Katılım Bankası, part of the Kuwait Finance House (KFH) group.
This experience in participation (Islamic) banking within Gulf banking groups underpins his work for financial institutions and for investors from the Gulf region.
Practice
Banking, finance and foreign investment
His banking and finance work covers participation finance, structured and project finance, syndicated and bilateral loans, debt capital markets, derivatives, payment systems and banking regulation. He has also worked on the development and financing of projects in energy, oil and gas, ports, mining and infrastructure.
For international clients, he advises on the Turkish law of foreigners, foreign direct investment, company formation, free zones and sanctions-related compliance in cross-border transactions.
Disputes
High-value corporate and family disputes
His dispute resolution practice includes commercial litigation, domestic and international arbitration, investment treaty arbitration, and enforcement and bankruptcy proceedings.
He has resolved corporate and family disputes involving values of more than USD 1 billion, and acted for the debtor, in both the restructuring and the enforcement stages, in one of the largest banking disputes in Turkey, amounting to approximately USD 800 million.
Restructuring
Concordat and debt restructuring
Mithat and the firm have substantial experience in concordat (konkordato) proceedings and out-of-court debt restructuring, acting for debtors and creditors in negotiations, payment plans and settlement protocols.
Academic work
Research and writing
His research focuses on private international law, international arbitration and the immunity of international organisations. He writes and speaks on these subjects and on the Turkish law of foreigners, and contributes to the firm’s Turkish Private International Law Portal.
