Double Tax Treaties — Free Money Left on Tables

Türkiye has one of the wider treaty networks in the region. In practice a treaty can cut the 15% dividend withholding substantially, reduce or eliminate withholding on interest and royalties, and protect you from being taxed twice on the same profit. The catch is procedural: relief is claimed with a tax residency certificate from your home country, in place before the payment. Paid first, claimed later means refund applications that take far longer than the certificate would have.

The pattern to remember: every incentive is prospective. The certificate, the zone registration, the treaty paperwork — all of it works only for what comes after it. The most expensive sentence in Turkish tax is “we will sort it out later”.

Your Filing Calendar — What a Turkish Company Actually Files

  1. Monthly: VAT return and withholding tax return — even at zero activity. This is why an accountant is a day-one hire, not an optimization.
  2. Quarterly: advance corporate tax on the running year’s profits.
  3. Annually: corporate income tax return; distribution decisions and the 15% withholding when you take dividends out.
  4. Event-driven: title deed fee at property transfers; stamp tax on many contracts (price it into deals before signing); payroll taxes from the first employee.

Structuring Questions Worth Asking Before Day One

  • Should profits come out as dividends, or partly as service/royalty fees under a treaty? The withholding difference is real money.
  • Does your activity fit a free zone or a technology development zone? Deciding after the office lease is too late.
  • Buying machinery? The E-TUYS certificate before import is the difference between paying and not paying customs duty and VAT.
